1. General
By purchasing artwork from Equation d’art (“the Gallery”), the customer agrees to these Terms & Conditions.

2. Artwork Information

• Every effort is made to accurately describe each artwork.
• As artworks are handmade, minor variations in colour, texture, and finish may occur.
• Images displayed online or in promotional material are for reference only. Actual colours may vary depending on screen settings and lighting.

3. Pricing

• All prices are quoted in Indian Rupees (INR) unless otherwise stated.
• Applicable GST and taxes will be charged as per Indian law.
• The Gallery reserves the right to revise prices before a purchase is completed.

4. Payment

• Full payment must be received before the artwork is delivered or collected unless otherwise agreed in writing.
• Payments may be made through approved payment methods offered by the Gallery.
• Ownership of the artwork transfers to the customer only after full payment has been received.

5. Certificate of Authenticity
Where applicable, the artwork will be accompanied by a Certificate of Authenticity issued by the artist or the Gallery.

6. Shipping and Delivery

• Delivery timelines are estimates and may vary depending on the destination and logistics.
• Shipping, packing, insurance, customs duties, or other charges, where applicable, shall be borne by the customer unless agreed otherwise.
• Risk of loss or damage passes to the customer upon delivery to the shipping carrier or upon receipt by the customer, as applicable.

7. Inspection of Artwork
Customers are requested to inspect the artwork immediately upon delivery.
Any damage or discrepancy must be reported to the Gallery in writing within 48 hours of receipt, along with clear photographs.

8. Returns and Refunds

• Original artworks are sold on a No Return, No Exchange, and No Refund basis unless:
  • the wrong artwork was delivered; or
  • the artwork was materially damaged before delivery and the damage is verified.
• Approved refunds, if any, will be processed through the original mode of payment.

9. Cancellation
Orders may be cancelled only before dispatch and with the written approval of the Gallery. Custom commissions and specially ordered artworks cannot be cancelled once production has commenced.

10. Copyright and Intellectual Property
Purchase of an artwork does not transfer its copyright or intellectual property rights.

• The artist retains all copyright unless expressly assigned in writing.
• Customers may not reproduce, scan, print, publish, or commercially exploit the artwork without prior written permission from the copyright owner.

11. Artwork Care
Customers are responsible for the proper handling, framing, installation, and maintenance of the artwork after delivery. Damage resulting from improper handling, environmental conditions, or misuse is not covered by the Gallery.

12. Limitation of Liability
The Gallery shall not be liable for indirect, incidental, or consequential losses arising from the purchase, transportation, installation, or use of any artwork, except where required by applicable law.

13. Privacy
Customer information will be collected and used solely for processing orders, customer service, legal compliance, and communication. Personal information will not be shared with third parties except where required to fulfil the order or by law.

14. Force Majeure
The Gallery shall not be responsible for delays or failure to perform its obligations due to circumstances beyond its reasonable control, including natural disasters, strikes, transportation disruptions, government restrictions, pandemics, or other force majeure events.

15. Governing Law
These Terms & Conditions shall be governed by the laws of India.

16. Jurisdiction
Any dispute arising from the purchase of artwork shall be subject to the exclusive jurisdiction of the competent courts in Ahmedabad, Gujarat, India.

17. Amendments
The Gallery reserves the right to modify these Terms & Conditions at any time. The version in effect at the time of purchase shall apply to that transaction.
